1. Acceptance of Terms

By accessing and using HealthNavy, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the system. These terms may be updated periodically, and continued use constitutes your acceptance of any changes.

2. Intended Use and Regulatory Classification

HealthNavy is a Clinical Decision Support System (CDSS) designed to assist healthcare professionals by providing evidence-based insights for respiratory illness evaluation, including pneumonia and tuberculosis. It is intended for informational purposes only and not as a substitute for professional clinical judgment.

HealthNavy does not make independent diagnostic decisions or prescribe treatments. Final diagnosis and patient care decisions must always be made by licensed clinicians.

⚠️ Per FDA guidance, HealthNavy qualifies under non-device CDS criteria (21st Century Cures Act), provided the user can independently review the basis for the software recommendations.

3. User Responsibility

The user must be a qualified healthcare provider.
The system is not intended for patient or layperson use.
Users must evaluate the context, patient condition, and clinical history when interpreting recommendations.
Use of HealthNavy does not transfer or reduce clinical responsibility or liability.

4. Limitations of Use

Recommendations are based on available data, clinical guidelines, and machine learning models.
Incomplete, incorrect, or out-of-date data may lead to suboptimal results.
Not suitable for critical care, emergency triage, or life-threatening scenarios without corroborating evaluation.

5. Transparency and Explainability

HealthNavy provides accessible explanations for its recommendations to ensure clinicians understand the reasoning. This supports ISO 9241-210 usability principles of control, trust, and understanding.

Users are encouraged to review input data and referenced guidelines before applying outputs.

6. Data Privacy and Security

All patient data is handled according to applicable data protection laws (HIPAA, GDPR). Users are responsible for obtaining patient consent and securing data access.

7. Usability and Human Factors

Follows ISO/IEC 62366 and ISO 9241-210 standards.
Includes clear interface feedback and alert systems.
Minimizes user error and supports training and onboarding.
Users must complete initial training and read the user manual before deployment.

8. Disclaimers

HealthNavy is provided "as is" without warranties. No liability is accepted for medical outcomes based solely on the system. Unless stated by regulators, HealthNavy is not a medical device.

9. Governing Law and Jurisdiction

These terms are governed by the laws of Uganda. Disputes shall be resolved through arbitration or the courts of that jurisdiction.
